Sediment and Erosion Control Plan

Ohio EPA’s Permitting Program Requirements

Construction sites, small and large, impact our streams and rivers by adding pollutants, especially sediment, to rainwater running off during construction.  Without control measures, this rainwater, also referred to as storm water, has a negative impact on our streams and environment.  Protecting our soil and water resources is cheaper than making repairs after the damage has occurred.  Yet this understanding is rarely practiced in the field.

A sediment and erosion control plan for construction sites (residential and commercial) is the first step in providing adequate protection for our soil and water resources during construction and building phases.  The sediment and erosion control plan describes all of the practices that are needed during storm water runoff events. 

In summary, to limit the negative impacts of construction projects, Ohio EPA administers a permitting program designed to document construction activity in the state and require practices that keep pollutants out of the streams.  The permitting program is mandated in the Clean Water Act and is part of the National Pollutant Discharge Elimination System (NPDES). 

The following permit process applies to construction projects that will be disturbing 1 (one) or more acres.  Most sites may get permit coverage under the General Permit For Discharge of Storm Water Associated With Construction Activity.  To obtain permit coverage, follow these steps, in order:

 

  1. Develop a Storm Water Pollution Prevention Plan (SWP3) for the construction site. Submit to the Brown SWCD, this same plan will double as the  Sediment and Erosion Control Plan required by the Brown County Subdivision Regulations;
  2. Submit a Notice of Intent (NOI) to Ohio EPA;
  3. Wait until you receive the Ohio EPA approval letter stating that you are covered under the general permit and the Brown SWCD approval letter for the Sediment and Erosion Control Plan;
  4. Ensure that contractors, subcontractors and staff understand their role in carrying out the Storm Water Pollution Prevention Plan (SWP3)/Sediment and Erosion Control Plan;
  5. Implement the plan;
  6. Proceed with construction, including regular maintenance and inspection of sediment and erosion controls and storm water management facilities.

The Brown County Planning Commission adopted subdivision regulations in March, 2003.  Within the regulation, homeowners and builders are required to follow sediment and erosion controls.  Use this page and diagram below to help reduce the sediment that leaves the construction site.
